Estate planning is not about just one document, it’s about making sure that the right people have the required decision making authority at the right time. Whilst a will plays a central part of the estate planning process, they generally don’t cover every practical question. For example:

  • Who can speak to doctors and make decisions about your condition?
  • What happens if you have a business interest, family trust, superannuation nomination, or jointly owned asset that does not sit neatly inside the will?

What Your Estate Plan Needs to Control

A useful estate plan starts with your intentions, but it also needs to match the legal and practical structure of your assets. That means looking at your family circumstances, financial affairs, business interests, personal priorities and the people you trust to make decisions.

Where estate planning documents can fail to line up

Problems often appear when documents are prepared separately over time. A will might name one person as executor, an old power of attorney might appoint someone else, and medical documents might not reflect your current relationships or wishes.

That can create uncertainty at exactly the wrong moment. For example, a child may expect to manage financial matters, but the enduring power of attorney appoints a former spouse or an unavailable relative. A business owner may leave shares under a will, but the company constitution or shareholders agreement may control who can receive or vote those shares. Superannuation and jointly held property may also need separate attention.

If there are capacity issues, timing matters. Documents should usually be reviewed before capacity becomes uncertain, because challenges can arise if there is doubt about whether a person understood what they were signing.

When reviewing an estate plan should move up the list

An estate plan should not be treated as a one-time task. Marriage, separation, children, blended family arrangements, major asset changes, illness, business changes, the death of an executor or attorney, or a shift in personal priorities can all make old documents harder to rely on.

A review should ask practical questions: are the right people appointed, are substitute decision-makers named, do gifts still make sense, are business control arrangements consistent with the will, and will the documents reduce uncertainty for those later involved in estate administration?
