Family mediation involves an independent mediator helping people discuss disagreements and explore possible agreements about parenting, property or finances. The mediator guides the discussion without taking sides or deciding the outcome. Each person can seek their own legal advice.
How can a lawyer help me prepare for mediation?

A lawyer can explain your position, review relevant documents and help identify your priorities before mediation. They can also advise on settlement proposals and, where the process allows, represent you during discussions. Preparation helps you assess your options more clearly.
Do I need to try mediation before going to court?

Before starting contested parenting proceedings, you generally need a section 60I certificate from a registered family dispute resolution practitioner unless an exemption applies. Applications for consent orders do not require this certificate. Property-only applications have separate pre-action requirements, which generally include attempts at dispute resolution and exchanging relevant financial documents, unless an exemption applies.
Is mediation suitable where there are safety concerns?

Family violence, power imbalances or difficulty participating can affect whether mediation is appropriate. Raise these concerns with the mediator or service before the process begins so they can assess suitability and safety. Depending on the circumstances, protective arrangements or another process may be appropriate. In parenting matters, a practitioner may issue a certificate stating that family dispute resolution is unsuitable, or an exemption may apply.
Are agreements reached at mediation legally binding?

Reaching agreement does not automatically make the outcome enforceable. Parenting plans are not legally enforceable, although they can be considered by a court. Parenting agreements can be formalised through consent orders. Financial settlements can generally be formalised through consent orders or a binding financial agreement, subject to the applicable legal requirements.
What happens if mediation does not resolve the dispute?

Mediation may help you resolve some issues even if you cannot agree on everything. Further negotiation or another dispute resolution process may help with what remains. If you still cannot reach an agreement, a lawyer can advise whether court proceedings are appropriate and explain the next steps.
